这是您与深圳市泰比特物联技术有限公司（下文简称"泰比特"或"我们"）之间的一份协议。使用我们的设备、软件或服务之前，请阅读这些使用条款。

This is an agreement between you and Shenzhen Tbit IoT Technology Co., Ltd. (hereinafter referred to as "Tbit" or "we"). Before using our devices, software, or services, please read these Terms of Use.

使用我们的设备、软件或服务即视为您同意受本协议条款的约束。如果您不接受本协议条款，您可以停止使用我们的设备、软件或服务。

Using our devices, software, or services constitutes your acceptance of and agreement to be bound by these Terms. If you do not accept these Terms, you may stop using our devices, software, or services.

您需要注册一个我们的账户并登录来使用我们的设备、软件或服务。您对任何服务的使用都必须遵守适用于这些服务的任何附加规则、政策、条款、通知等，这些规则、政策、条款和通知等为本用户协议的组成部分，与本协议具有同等效力。

You need to register for an account with us and log in to use our devices, software, or services. Your use of any services must comply with any additional rules, policies, terms, notices, etc. applicable to those services, which form part of these Terms of Service and have the same legal effect as this agreement.

我们的设备、服务使用条款如下：

The Terms of Use for our devices and services are as follows:

"设备"是指我们公司提供的各种物联网设备（包括但不限于【自助洗车机、自助打印机、共享童车、共享洗宠、毫米波监测设备、智能传感器、物联网网关、环境监测设备、智能控制器、数据采集终端等】），以及任何情况下为这些设备所提供的我们的配件或软件等。

"Devices" refer to various IoT devices provided by our company (including but not limited to [self-service car wash machines, self-service printers, shared children's car wash, shared pet washing, millimeter-wave monitoring devices, smart sensors, IoT gateways, environmental monitoring devices, smart controllers, data acquisition terminals, etc.]), as well as any of our accessories or software provided for these devices under any circumstances.

"服务"指我们为我们的设备用户提供的软件、云端服务、数据分析和其他服务，包括但不限于设备管理、数据可视化、远程监控等功能。

"Services" refer to software, cloud services, data analysis, and other services we provide for our device users, including but not limited to device management, data visualization, remote monitoring, and other functions.

"软件"是指我们为您提供的所有可在我们的设备上或其他设备上使用的软件，包括移动应用程序、网页控制台、小程序等，但不包括第三方运营者提供的内容。

"Software" refers to all software we provide that can be used on our devices or other devices, including mobile applications, web consoles, mini-programs, etc., but excluding content provided by third-party operators.

1、用户使用规则

1. User Rules

a.【账号注册】

a.【Account Registration】

您无需用户账号即可浏览我们的软件。如果您想使用更多功能与服务，您必须注册软件账号。您也可以通过社交账号注册/登录，例如：微信，为此您同意向我们分享社交账号的部分个人信息。

You do not need an account to browse our software. If you want to use more features and services, you must register for a software account. You may also register/login through social accounts, such as WeChat, and in doing so, you agree to share some of your personal information from your social account with us.

您注册的账号的所有权归我们所有，您仅有有限的使用权。未经我们同意，您不得出租、转让、出借、赠与、处置该账号，也不得冒用他人身份注册账号、利用机器人等自动化工具批量注册账号，若您违反该规定的，我们有权利收回账号或对账号进行冻结、封禁、关停、强制注销等处置。

The account you register is owned by us, and you only have limited usage rights. Without our consent, you may not rent, transfer, lend, gift, or dispose of the account, nor may you register an account using another person's identity or use automated tools like robots to batch-register accounts. If you violate these provisions, we have the right to reclaim the account or take actions such as freezing, banning, suspending, or forcibly deleting the account.

您自行妥善保管账号，因您保管不善导致账号泄露进而造成您的财产、人身损失的，由您自行承担全部责任。如我们检测到账号存在登录IP地址异常、登录频繁、交易频繁等非正常现象的，我们有权不经通知您而出于账号安全对账号进行冻结、暂停登录、拒绝访问等处置。

You are responsible for keeping your account secure. If your account is compromised due to your failure to properly safeguard it, resulting in property or personal losses, you shall bear all responsibility. If we detect abnormal phenomena such as abnormal login IP addresses, frequent logins, or frequent transactions on an account, we have the right to take actions such as freezing, suspending login, or denying access to the account for account security purposes without notifying you.

b.【用户资格】

b.【User Eligibility】

在注册、登录及使用软件服务过程中，用户应当具备中华人民共和国法律规定的与您行为相适应的民事行为能力。若您不具备前述与您行为相适应的民事行为能力，则您应当在您的监护人的参与下使用本款软件，您及您的监护人应依照法律规定承担因此而导致的一切后果。

During registration, login, and use of the software services, users should have the civil capacity appropriate to their behavior as required by the laws of the People's Republic of China. If you do not have the civil capacity appropriate to your behavior, you should use this software under the participation of your guardian, and you and your guardian shall bear all consequences in accordance with the law.

您需要年满16周岁方可独立使用我们的设备、软件和服务，若您未满16周岁，请不要使用我们的设备、软件或服务，因此造成的您的人身、财产损失、交通事故责任以及对其他第三人造成损失的，由您及您的监护人自行承担责任。

You must be at least 16 years old to independently use our devices, software, and services. If you are under 16 years old, please do not use our devices, software, or services. Any personal or property losses, traffic accident responsibilities, or losses caused to third parties shall be your responsibility and your guardian's responsibility.

c.【禁止性信息】

c.【Prohibited Information】

您不能通过软件发送或传播含有法律、行政法规禁止性信息。否则，我们可对您发布的信息依法或依本协议采取必要的处置措施，并有权视情节采取警告、限期改正、暂停服务、关闭订单、禁止交易、封禁账号、强制注销账号等措施。

You may not send or disseminate information through the software that contains content prohibited by laws or administrative regulations. Otherwise, we may take necessary measures against the information you publish in accordance with the law or this agreement, and may, depending on the circumstances, take actions such as warnings, requiring corrections within a specified time, suspending services, closing orders, prohibiting transactions, banning accounts, or forcibly deleting accounts.

此类信息包括但不限于：

Such information includes but is not limited to:

(1) 反对宪法所确定的基本原则的；

(1) Content that opposes the basic principles established by the Constitution;

(2) 危害国家安全、泄露国家秘密、颠覆国家政权、破坏国家统一、损害国家荣誉和利益的；

(2) Content that endangers national security, leaks state secrets, subverts state power, damages national unity, or harms national honors and interests;

(3) 煽动民族仇恨、民族歧视，破坏民族团结的；

(3) Content that incites ethnic hatred or discrimination, or undermines ethnic unity;

(4) 破坏国家宗教政策，宣扬邪教和封建迷信的；

(4) Content that destroys national religious policies, promotes cults or feudal superstitions;

(5) 散布谣言，扰乱社会秩序，破坏社会稳定的；

(5) Content that spreads rumors, disrupts social order, or undermines social stability;

(6) 散布淫秽、色情、赌博、暴力、凶杀、恐怖或者教唆犯罪的；

(6) Content that disseminates obscenity, pornography, gambling, violence, homicide, terrorism, or incites criminal activities;

(7) 恐吓、侮辱、攻击、诽谤他人，侵害他人合法权益的；

(7) Content that threatens, insults, attacks, or defames others, or infringes upon the lawful rights and interests of others;

(8) 利用本平台从事洗钱、窃取商业秘密、窃取个人信息等违法犯罪活动的；

(8) Content that uses this platform to engage in money laundering, stealing business secrets, stealing personal information, or other illegal activities;

(9) 发布任何侵犯他人著作权、商标权等知识产权及其他合法权利的；

(9) Content that publishes any information that infringes upon the copyright, trademark rights, or other legitimate rights of others;

(10) 含有法律、行政法规禁止的其他内容的（包括涉嫌构成电信诈骗、网络暴力行为等内容的）。

(10) Content that contains other information prohibited by laws and administrative regulations (including content suspected of constituting telecom fraud, cyberbullying, etc.).

2、功能与软件

2. Functions and Software

a.设备配置与使用

a.Device Configuration and Use

您使用我们的设备可能需要通过配置和调试来正常工作。我们不对由于使用者缺乏技术经验或未能遵循产品说明书或《用户手册》或《操作指南》中的使用说明所造成的设备故障或数据丢失负责。如果您使用我们的设备，您应对设备的安全使用负全责，遵守所有您所在地区的法律法规及安全规范。

Using our devices may require configuration and debugging to work properly. We are not responsible for device failures or data loss caused by users' lack of technical experience or failure to follow the instructions in the product manual, User Manual, or Operation Guide. If you use our devices, you are fully responsible for the safe use of the devices and must comply with all laws, regulations, and safety specifications in your region.

b.数据备份和同步

b.Data Backup and Synchronization

我们的设备可能具有对设备上的部分数据进行云备份的功能，可备份数据包括但不限于设备配置、历史数据、告警记录、用户设置等，备份后您可以将这些数据同步到我们的其他设备。

Our devices may have the function to back up some data on the device to the cloud. Backupable data includes but is not limited to device configuration, historical data, alarm records, user settings, etc. After backup, you can synchronize this data to our other devices.

c.数据分享服务

c.Data Sharing Services

我们的设备可能具有一些功能，可以让您通过数据看板或其他功能与其他用户分享您的监测数据。如果您选择分享您的数据，这意味着您的信息（包括但不限于图表、报告、统计数据）将会传输至服务器，并对您授权的用户可见。

Some functions of our devices may allow you to share your monitoring data with other users through data dashboards or other features. If you choose to share your data, it means your information (including but not limited to charts, reports, and statistical data) will be transmitted to servers and be visible to users you authorize.

d.设备发现服务

d.Device Discovery Service

我们的设备的部分应用程序中的某些功能，可以让您发现网络中的其他设备或传感器。您可以使用这些功能来管理设备组网，并查看设备运行状态。

Some functions in the applications of our devices may allow you to discover other devices or sensors on the network. You can use these functions to manage device network groups and view device operating status.

e.软件的使用

e.Use of Software

除本协议另有规定外，您只能在我们的设备上使用这些软件。对于适用于软件的附加条款，请参见我们的设备或用户手册的配套应用程序中的法律或类似部分中的条款。

Unless otherwise specified in this agreement, you may only use this software on our devices. For additional terms applicable to the software, please refer to the terms in the legal or similar sections of the accompanying applications in our device or user manuals.

未经我们书面同意，您不得将我们的设备及其关联软件全部或任一部分进行反向工程、拆分、重组、更换、替换成第三方的软件或硬件等处理，否则，因此造成的损失由您承担，且我们有权利单方面终止或暂停您使用我们的设备或软件。

Without our written consent, you may not reverse engineer, disassemble, reorganize, replace, or substitute any or all of our devices and associated software with third-party software or hardware. Otherwise, you shall bear any resulting losses, and we have the right to unilaterally terminate or suspend your use of our devices or software.

3、连接性和可用性

3. Connectivity and Availability

a.互联网和无线连接

a.Internet and Wireless Connections

我们的设备中的一些功能可能需要来自第三方提供商的互联网连接或数据流量才能正常使用。在此情况下，您的互联网连接或数据流量取决于由您的供应商规定的费用、限制条件、条款和限制因素，这部分联网和连接产生的费用由您自行承担。

Some functions of our devices may require internet connection or data traffic from third-party providers to function properly. In this case, your internet connection or data traffic is subject to fees, limitations, terms, and restrictions as stipulated by your provider. You shall bear the costs incurred for such network connections and connections.

b.可用性

b.Availability

一些服务可能不可用、（根据设备型号和所在地区）有所差异、限时提供或需要单独订阅。此外，如果我们的设备需要无线数据服务，并且位于无法访问此类服务的区域，那么您可能无法使用我们设备的部分或全部服务或其他功能。我们对由于无线数据服务不可用或相应的服务失效不承担责任。

Some services may not be available, may vary depending on the device model and region, may be offered for a limited time, or may require a separate subscription. In addition, if our devices require wireless data services and are located in areas where such services are inaccessible, you may not be able to use some or all of our device services or other functions. We are not responsible for the unavailability of wireless data services or corresponding service failures.

4、平台服务规范

4. Platform Service Standards

a.【产品购买】

a.【Product Purchase】

对于明确标明为第三方商家提供的产品（如有），由第三方商家进行产品发货、开具发票、物流配送、售后服务，向用户承担产品质量保证责任并履行相应服务承诺，并对其经营活动承担法律责任。我们会在第三方商家的购买页面等位置以显著方式提醒您该等产品或服务由第三方提供。

For products clearly marked as provided by third-party merchants (if any), the third-party merchants shall be responsible for product delivery, invoicing, logistics distribution, after-sales services, product quality assurance, and fulfilling corresponding service commitments, and shall bear legal responsibility for their business activities. We will prominently remind you on the purchase page of the third-party merchant that such products or services are provided by third parties.

b.【产品缺货】

b.【Product Out of Stock】

由于市场变化及各种以合理商业努力难以控制的因素的影响，如您提交的订单信息中选购的产品无相应库存，您有权取消该产品订单。若您已经付款，商家将与您协商一致后为您办理换货或退款。

Due to market changes and other factors that are difficult to control with reasonable commercial efforts, if the product you ordered is out of stock, you have the right to cancel that product order. If you have already made payment, the merchant will coordinate with you to arrange for replacement or refund.

c.【技术支持服务】

c.【Technical Support Services】

我们提供物联网设备的技术支持服务，包括但不限于设备安装指导、配置支持、故障诊断等。技术支持服务的具体范围和响应时间以我们公布的服务标准为准，您向我们提起的请求超出我们公布的标准以外的，我们有权利拒绝提供相关服务。

We provide technical support services for IoT devices, including but not limited to device installation guidance, configuration support, fault diagnosis, etc. The specific scope and response time of technical support services shall be subject to the service standards we publish. We have the right to refuse to provide related services for requests that exceed the standards we publish.

d.【数据服务】

d.【Data Services】

我们提供设备数据的存储、分析和可视化服务。数据服务的存储期限、处理能力等以我们公布的服务规格为准。

We provide data storage, analysis, and visualization services for device data. The storage period and processing capacity of data services shall be subject to the service specifications we publish.

除法律法规明确规定以外，我们有权利自行决定数据的存储期限，并有权决定是否收费，对于超出免费额度的服务，我们可能需要您额外付费。如您在我们通知您的期限内未予以付费的，我们有权利删除该等数据，您在我们指定的合理期限内未进行数据备份的，该数据删除或丢失所造成的一切损失由您自行负责。

Except as expressly required by laws and regulations, we have the right to independently decide the storage period of data and whether to charge fees. For services exceeding the free quota, we may require you to pay additional fees. If you do not make payment within the time period we notify you, we have the right to delete such data. If you fail to back up your data within the reasonable time period we specify, you shall bear all losses resulting from the deletion or loss of such data.

5、知识产权

5. Intellectual Property Rights

a.用户内容

a.User Content

您应保证您上传内容的所有权和知识产权都是您所拥有或已获得合法授权（且含转授权）的。如任何第三方基于您发布的内容提出侵权主张或投诉的情况下，我们有权在不经事先通知您的情况下对您发布的内容进行删除或屏蔽。

You should ensure that you own all ownership and intellectual property rights of the content you upload, or have obtained legitimate authorization (including sublicensing rights). If any third party makes infringement claims or complaints based on the content you publish, we have the right to delete or block the content you publish without prior notice.

b.授权许可

b.License Grant

当您使用我们的软件及相关服务分享、发布、上传任何受知识产权保护的内容时，将视为您授予我们独占、免版税、不可撤销、可转让、可转授权和全球范围内使用的权利（包括但不限于复制权、翻译权、汇编权、信息网络传播权、改编权等）。

When you use our software and related services to share, publish, or upload any content protected by intellectual property rights, you shall be deemed to have granted us exclusive, royalty-free, irrevocable, transferable, sublicensable, and worldwide rights (including but not limited to reproduction rights, translation rights, compilation rights, information network communication rights, adaptation rights, etc.).

c.公司知识产权

我们公司为设备、软件及相关服务的开发、运营提供技术支持，并对软件及相关服务的开发和运营等过程中产生的所有数据和信息等享有法律法规允许范围内的全部权利。我们有权自行决定使用、许可他人使用以及转让、处置该等权利。

Our company provides technical support for the development and operation of devices, software, and related services, and enjoys all rights within the scope permitted by laws and regulations for all data and information generated during the development and operation of software and related services. We have the right to independently decide to use, license to others, and transfer or dispose of such rights.

6、数据处理与AI服务

6. Data Processing and AI Services

a.数据处理服务

a.Data Processing Services

我们可能使用您的设备数据进行分析处理，以提供设备优化建议、故障预测等增值服务。数据处理严格遵循数据安全和隐私保护规定。

We may use your device data for analysis and processing to provide value-added services such as device optimization suggestions and fault prediction. Data processing strictly follows data security and privacy protection regulations.

b.第三方AI服务

b.Third-Party AI Services

本平台部分功能接入了第三方提供的人工智能服务。我们仅作为技术接入方，无法决定和干预第三方AI服务方提供的内容，故我们不对第三方服务及其内容的准确性、完整性负责。用户应对使用AI服务生成的结果承担责任。

Some functions of this platform integrate artificial intelligence services provided by third parties. We serve only as a technical integrator and cannot determine or intervene in the content provided by third-party AI service providers. Therefore, we are not responsible for the accuracy or completeness of third-party services and their content. Users shall bear responsibility for the results generated using AI services.

7、基本条款

7. General Terms

a.信息收集

a.Information Collection

软件将为我们提供有关您使用我们设备及相关服务的交互信息。这些信息可能会用于云端处理，以提升您的服务体验并改进我们的产品和服务。

The software will provide us with information about your interactions with our devices and related services. This information may be used for cloud processing to enhance your service experience and improve our products and services.

b.协议修改

b.Agreement Modifications

我们可以自行决定修改及更新本协议的任何条款，并将修改后的条款公布在更新后的软件版本上。如果您在修订版协议生效日期后点击同意或继续使用我们的设备或软件或服务，即表明您已接受新的条款。

We may modify and update any terms of this agreement at our sole discretion, and will publish the modified terms on the updated version of the software. If you click agreement or continue to use our devices, software, or services after the effective date of the revised agreement, it constitutes your acceptance of the new terms.

c.服务终止

c.Service Termination

在下列情况下，我们有权立即拒绝或终止我们向您提供的部分或所有服务：（1）保护我们的社区或服务；（2）您的行为造成法律风险或违反法律法规；（3）您违反了本使用条款；（4）您侵犯了他人的知识产权或其他合法权益；（5）法律规定或其他法律要求。

In the following circumstances, we have the right to immediately refuse or terminate some or all of the services we provide to you: (1) To protect our community or services; (2) Your actions cause legal risks or violate laws and regulations; (3) You violate these Terms of Use; (4) You infringe upon the intellectual property rights or other legitimate rights and interests of others; (5) Legal provisions or other legal requirements.

d.争议解决

d.Dispute Resolution

本协议受中华人民共和国法律管辖并按照中华人民共和国法律解释。因本协议引起的或与本协议有关的任何争议，应本着友好的原则协商解决；如协商不成，您有权向我们公司所在地法院提起诉讼。

This agreement shall be governed by and construed in accordance with the laws of the People's Republic of China. Any disputes arising from or related to this agreement shall be resolved through friendly negotiation. If negotiation fails, you have the right to file a lawsuit in the court where our company is located.

e.免责声明

e.Disclaimer

我们依照法律规定履行相关义务，但对于因不能预见、不能避免且不能克服的原因导致的合同履行障碍，我们不承担违约责任和赔偿责任，具体情况包括但不限于：（1）不可抗力事件；（2）第三方服务商、电信运营商、云服务提供商等任何第三方原因导致的网络故障、服务中断；（3）设备、软件与系统维护期间的服务中断；（4）黑客攻击或其他非我们原因造成的网络安全或数据安全事件或服务中断。

We fulfill relevant obligations in accordance with the law, but we do not assume contractual or tort liability for obstacles to contract performance caused by unforeseeable, unavoidable, and insurmountable causes. Specific circumstances include but are not limited to: (1) Force majeure events; (2) Network failures or service interruptions caused by any third parties such as third-party service providers, telecom operators, or cloud service providers;

(3) Service interruptions during device, software, or system maintenance; (4) Cyber security or data security incidents or service interruptions caused by hacker attacks or other reasons not attributable to us.
